A LETTER TO JUDGE GERARD PHILLIPS, PRESIDENT OF THE PIC

Dear Judge Phillips

 

re XXX v Workers Compensation Nominal Insurer (icare)

 

Is it true that icare has already spent over $500k pursuing Ms. L. in relation to this matter over the past five years?

 

Is it true that icare will continue to pay CM $100k a year until he turns 65?

 

Is it true that Mr. M. has also been provided with a lump sum of $70,000 in compensation by icare for the bullying he experienced at the hands of Ms. L?

 

Is it true that icare pays for Mr. M's weekly counselling sessions, for his weekly exercises with a private trainer, for all his dental and medical expenses and for his travel expenses between his home and the car yard at xxxx where he works?

 

Is it true that icare also pays  all expenses relating to his 'comfort dog'?

 

If the answer to all of these questions is 'yes', (please correct me if my assumption that it is, is incorrect) the question arises:

 

"What has happened in Mr. M's life that has rendered him not only incapable of working but in such a dreadful state mentally that he requires what amounts to an invalid pension for life?"

 

The answer to this question that the PIC has arrived at is that in 2019, during the 28 days that Mr. M worked for Ms. L, he was severely traumatised by her bullying.

 

And what is the evidence in support of this bullying that the PIC has relied on? A report by a psychiatrist by the name of Dr. Thomas Oldtree Clarke.

 

And what evidence did Dr. Thomas Oldtree Clarke provide to icare, and hence to the PIC, of which you are President?

 

A conversation Dr. Thomas Oldtree Clarke had with Mr. M. on the telephone. Just one conversation. And, as I understand it (please correct me if I am wrong) Dr. Thomas Oldtree Clarke did not have access, during this one conversation, to Mr. Ms' 30+ year history of mental health problems, his drug and alcohol addictions, his many lies about his life, or to the circumstances surrounding his attempted suicide just weeks before Ms. L. offered him a part-time job.

 

This does not pass the pub test, Judge. 

 

You are the captain of the good ship PIC and you have allowed this legal farce, replete with gross incompetence on the part of many, to lead to Ms. L. being forced to sell her house - her only asset - in order to pay icare $150,000.

 

This letter, with two names redacted, will be published, along with other relevant correspondence on my blog.
